Disability claimants who have been denied their benefits at first attempt can always appeal for reconsideration. As soon as they receive the denial letter, they are advised to contact the social security agency immediately to request an appeal.

After an appeal has been requested, the social security district office will mail the required appeal forms to the claimant. With the help of a disability claim attorney or representative, a claimant may accomplish the paperwork and submit it to the agency. A claimant has to make sure that the appeals document reaches the agency before the deadline of its submission.

Even after the forms have been mailed, a claimant must call the social security office to inform them that the deadline has been met in order to give one’s case a so-called ‘protected date’. This will also provide some security in the event that appeal forms get lost in the mail.

Generally, denied claims pursued through the appeals process have a much greater chance of being subsequently awarded of benefits than filing a new application.

The administrative appeals process in a disability claim involves four steps:

1. Initial Determination – When a claimant is denied disability benefits on their initial application, they will receive written notification advising him of the initial determination and their right to a reconsideration of the decision. The claimant must then make an appeal and request for a reconsideration of the decision. An initial determination becomes final unless reconsideration is requested with sixty (60) days from the date of receipt of the notice of the determination.

2. Reconsideration Determination – At the reconsideration level, the administration will review the initial determination and any other medical evidence that is submitted by the parties or otherwise obtained.

A reconsidered determination becomes final unless a hearing is requested within sixty (60) days from the date of claimant’s receipt of notice of the reconsidered determination, or unless such determination is revised in accordance with 20 CFR Sec. 404.905, or unless the expedite appeals process is used in accordance with 20 CFR sec. 404.900 (a)(6)

3. Administrative Law Judge Decision – Before an Administrative Law Judge (ALJ), a claimant is provided the opportunity for a full hearing during which he can present evidence and legal argument and cross examine witnesses. The ALJ renders a decision stating his finding of fact and conclusions of law.

The decisions are based on the evidence presented and evaluated at the hearing or included in the hearing record. If the claimant is dissatisfied with the decision of an administrative law judge, he must file a written appeal within sixty (60) days after his receipt of the ALJ decision to the Appeals Council for their review.

4. Appeals Council Review – The council reviews the ALJ’s decision, which it may affirm, modify or reverse or vacate. The council may also remand the case to an ALJ for rehearing, or take further testimony in the case.

After notification of its decision, a claimant has sixty days from receipt of the decision to seek review of the district court by filing a civil action.

We have all heard the claims of being able to settle tax debts for “pennies on the dollar”. It sounds great, but does it really work? It may seem too good to be true, and the truth is that it is not for everyone. But for those who qualify, it can be a real lifesaver.

An Offer in Compromise, or OIC, is an arrangement with the IRS that allows an individual or business to negotiate a settlement amount that is less than the total amount owed. It is important to realize that the IRS considers this a method of last resort; fewer than 1% of all balance due accounts are resolved this way. The IRS greatly prefers installment payments that will result in the eventual collection of the entire balance that is due. However, the OIC option is out there, and if you meet one of the following conditions, it could work for you.

There are three conditions that a taxpayer can fall under to apply for OIC:

1. Doubt as to liability–you are claiming that the IRS made a mistake, and you do not owe the money they are saying that you do.

2. Doubt as to collectibility–you as the debtor are telling the IRS that you do not have the money or assets available to pay the debt, and you never will. The IRS will calculate your available assets through a formula to determine your settlement amount, such as:

Settlement Amount = 60 months of disposable income + the equity in all of your assets.

3. Effective tax administration–you are claiming “special circumstances” because collection of the debt would create an undue hardship and would be unfair. This option is most often used for elderly or disabled taxpayers.

Recent tax legislation requires that those applying for an OIC submit a $150 application fee, along with a 20% payment of the proposed settlement offer. These fees are non-refundable; even if your offer is rejected, the IRS will keep this money. There are exceptions to the fee requirement. If you qualify for a low-income waiver, or if claiming doubt of liability, you will not have to pay the fees. The IRS has two years to make a decision on your offer.

If your OIC does get accepted by the IRS, it is essential that you remain in compliance with the filing and payment of all taxes for a period of five years or until the amount offered is paid in full, whichever is longer. Failure to do so will cause you to be in default on your OIC agreement.

A large past due tax debt can be an intimidating thing; after all, it’s not just some annoying collection agency pestering you, it’s the federal government. However, it is important when faced with such a challenge to take a deep breath and examine your options carefully and realistically. If you fit into one of the categories described above, an Offer in Compromise with the IRS could be just the thing to get that burden off of your shoulders.

Be Your Own Boss in Victorville

Entrepreneurs and Investors received a firsthand look at the economy of San Bernardino County, which brought the focus to the High Desert. Number’s show a different tale than the stories that were conveyed in the other counties.

Logistics is the cornerstone of the growth with warehouse and industrial development leading the other counties in Southern California.

Four of the top deals in the county exceeded all the industrial development in three other counties combined. Referring to Los Angeles, Orange, and San Diego counties.

More people from outside of the County are coming into the communities to find out about doing business in the High Desert.

The pioneer Newell Rubbermaid made it happen by opening its 400.000 square foot distribution center at the park in September. Things are actually moving at the former George Air Force Base.

Developers are putting their ink and money on the line for a new industrial and commercial space in the High Desert, which has some of the lowest land prices in Southern California. With other parts of Southern California running out of room, it seems that this will be the place for much needed development.

Adelanto Gateway Logistics Center is advertising about 7 million square foot of industrial space to be developed.

Brokers and developers are working hand in hand on making these communities a place for all new development by offering an easy commute, affordability and working with the cities on the improvement of each community.

Raising Boys!

I have seven sons.

Have you recovered from the shock yet? Most people pause in awed reflection when I tell them that.

I appreciate the response because it in not an easy task raising boys in the 21st century.

I did not set out to have seven sons. I actually bought into the current mantra of two kids: a boy and a girl.

Then we would be the socially perfect family. But that is not how my story turned out.

It all started when we had just 2 boys. We had a daughter born who was chronically handicapped and died.

My heart was broken and as bad as I wanted another baby Quick! to heal my emptiness, my husband said no.

But being the ‘fertile Myrtle’ that I am blessed to be, and my husband the ‘Don Juan’ that he is, I was soon pregnant again. And so 9 months later we welcome a third son. A fourth and fifth son came every 23 months, until numbers 6 and 7 came just 12 minutes apart. Yep! Twin boys!

We did finally have a daughter and the remarks we get are ” Did you keep trying until you got a girl?”

Emphatically NO! We wanted and loved each and every child, whether they are son or daughter, blue or pink!

But being that I have had consistent experience with sons, let me share with you some wisdom. Hopefully it will aid you on the journey of raising boys into men.

First off, boys are noisy. They love sounds, the louder, the better. They do not appreciate the fine art of dialogue and conversation. (That comes when they are teens. More on this later.) There are exceptions to this. One of the exceptions is my son, Thomas. When he was 18 months old, he stood up in his stroller while we were walking around the block, and yelled to his older brother to get back and do the dishes. I kid you not! We nick-named this son St. Thomas talkus a lot-us.

Most boys will opt to play guns and make shooting noises, or play with cars and make ‘vrooming’ noises, or trains and make choo-choo noises. If there is sound, they will produce it. Boys love weapons. I remember my oldest son, Daniel, biting his grilled cheese sandwich into a pistol and firing away. Contrary to popular opinion, playing with toy guns does NOT make your boy violent. It actually aids in rounding him out to be a brave adult. Did you ever see lion cubs wrestling and stalking each other? They were developing and using skills that they would need later on. It is the same with boys. Through out history it has been the males who go off and fight for family, home, and country. How did they learn to have such courage in the face of death? By playing bravely as kids. By the way, Daniel is a United States Marine.

At this point I would like to interject a few warning signs. Unnecessary roughness and bullying is not to be tolerated. Unchecked bad behavior can have long lasting effects for all sides. Violent video games played for hours on end, I do believe, dull the senses and sensitivies of the players. It is our personal family rule that we do not allow them in our house.

Boys are very energetic. Most likely you have discovered this for yourself. This is perfectly normal and there should be no cause for alarm. Boys need lots of fresh air and play time outside. They need to swing from ropes on trees, and build forts, and ride around on bikes. A boy who has had a vigorous day outside will sleep better and be less likely to cut up and disturb others indoors.

Teachers are currently having problems with many boys in school because these boys are not getting enough energy out through play. Parents of these boys resort to medicines to settle their sons down. This is not a blanket condemnation, for I am sure that it is warranted in some cases. But for many boys, if they were allowed longer and more frequent recesses, the teachers would get better students out of them.

Boys are a little slower on the thinking end of it. No offense, guys! Boys are wired differently, God designed them that way. What took my boys 6 years to master, academically speaking, my daughter grasped in 4 ½ or 5 years.
What to do? Try teaching them is different ways. Maybe they are a visual learner and need to see the concept played out with hot wheels cars: 2 trucks were parked on the street. 2 sedans came and parked behind them. How many vehicles are on the street altogether? If they are not getting phonics, have them write the letter in a pie plate of clean sand. Read lots of books together out loud.

This slowness should not be seen as a negative attribute in your son. When you need him to act and respond quickly, they are more than able to. Look at it as raw courage. Where we females are timid to lurk, a boy will dive in without a second thought. I use this very effectively when there are spiders in my house that I want removed.

Boys need their fathers. They need to identify with positive male role models. Spend time with your sons, Dads.
Play with them. Hug them. Get in the habit now while they are young and they will still want your company when their teen peers are pushing away their own folks. In our family we call this special time Bud Time. The children crave and yearn for this time with their Dad, just one on one.

There is still a place for Mom, but in a different way. Mothers can show their sons the fullness of femininity. When they are seriously looking for a marriageable spouse, they won’t be able to help looking for similar qualities like they saw in their Mothers.

Lastly, our modern culture is so filled with noise and distractions. If you can quiet your home down and leave room for conversation, you will find your parent-child relationships flourishing rather than floundering. My teen boys like to talk after 10pm when I am ready to make the descent to slumber. My advice to you is this: when your son (or daughter) wants to talk, LISTEN, even if it is past bedtime. You will actually look back and treasure those late night conversations.

My seven sons are still growing. Only two sons have moved out where they are supporting themselves or their own family. We are still in ‘boot camp’ training and raising the other five to be courageous, faithful, hardworking and virtuous men who can impact their community in positive ways.

How to Read a Tenancy Agreement

If you’re new to the property rental market, setting up a tenancy agreement for the first time can feel more complicated than it has to be. From legal terminology to finding the right agreement to suit your property investment needs, it’s easy to see why many property investors hire a property manager.

It doesn’t have to be this way. All you need is a simple understanding of the legal terminology to always keep you in the know.

As a professional landlord, there are 4 types of tenancy agreements that you need to be aware of:

Estate for years:

This is the most common of the 4 property leases, offering tenants a specified beginning and finishing date for their lease. The basis around this lease is to ensure you always have control of who lives in your rental property at what time. So when the lease expires, the tenant is expected to leave without the aid of a notice.

This lease is also perfect for controlling rent, allowing you to specify when you want to receive your rental payment.

If you’re hoping to target the student accommodation market with your rental property, Estate for years is more than ideal.

By applying this type of lease to your property, when one tenant moves out you can already have another tenant waiting to move in.

Estate from Period to Period:

Legally known as a ‘periodic tenancy’, this type of tenancy refrains from giving an end date to the tenancy agreement. The only requirement is that specified periods of tenancy and rental payment take place, for example the tenant must pay you rent by the 25th of every month.

If you choose to adopt this type of tenancy agreement to your property, there is only one condition – a notice to vacate must be given to your tenants. And the reason? There is no defined termination date.

Depending on what area of the rental market you are aiming for, it is quite probable that you will use this type of lease for the majority of your tenancies. Its flexibility means if you find a tenant who is in the rental market for the long run, you can profit from a continued tenancy relationship and save yourself the time of finding a new tenant.

Estate at Will:

Of all the leases, this is the most unstable with no specified ending date or a defined tenancy for the monthly payments.

We recommend you avoid this one. It lacks control on your monthly rental payments and runs the risk of you being left with the debt.

Estate at Sufferance:

Is a leasehold estate that arises when a tenant overstays their lease agreement and refuses to leave.

This is probably the worse of all the agreements, and revokes your claim on the property. Unless you are able to establish a new agreement with the tenant, the situation could get very complicated and may even end up in court.

With all these leases, it is important to remember that according to the Statute of Frauds, leases over one year should be declared in writing to make them enforceable.

So if you create such an agreement it should spell out the rights and obligations of both you the owner/landlord and the tenant… including maintenance, repairs and utilities. It may sound silly but these features will add to the security of your agreement. Allowing you to always remain in control.

Keep yourself aware of the legalities. If you do choose to hire a property manager they can deal with all the tenancy agreement, from start to finish. But by acquiring an understanding of the rental market and your lease requirements, you can keep yourself in the know and always be one step ahead.

House repossessions have soared from the beginning of 2008, people who are hit hardest by these repossessions are borrowers who have borrowed more than they can afford against their property. Other causes that have emerged are fraudulent activity by property developers.

Despite the recent 0.25% cut in base rates, which will reduce a typical £100,000 mortgage by £16 per month, people who are struggling will still feel the pressure. Banks are tightening their lending criteria amid the credit crunch, anyone who has existing large debts will see the cost of credit rising for them, instead of reductions in home loan bills they will feel the pinch even more.

Last year more than 27,000 houses were repossessed by banks and building societies last year, this is the highest number seen since 1999 when 30,000 houses were taken back by institutions.

The Council of Mortgage Lenders (CML) wants to highlight that this number is only a small fraction of the 75,500 people who saw their homes repossessed at the height of the UK’s last property recession. Despite this the CML is expecting to see this figure rise in 2008 as the economy continues to slow, fraudulent deals increase and the credit crunch tightens.

Despite the fact that the housing market has slowed from the end of 2007 there is still much activity below the surface. Usually house repossessions only rise when the market has been inactive for over a year, and anyone who has serious debts have to sell their way out of their debts.

House sales remained steady throughout most of 2007 and only tailed off towards the very end of the year, house sales in December are expected to be 1.05 million, which is only a very slight decrease from 2006’s 1.1 million. Halifax found that house prices in 2007 finished the year up 9.4%, this has been attributed to Scotland’s successful market.

Charcol mortgage broker, Ray Boulger said: “Despite recent interest rate rises, most home buyers are not currently at any risk of losing their homes. I suspect that those getting into difficulty now fall into a few groups who have over-committed themselves.

“There is also evidence of fraudulent activity, particularly in the area of new developments. It would take house prices to seriously dive before the bulk of the market has anything to worry about.”

Those who are most at risk of repossession are people who have excessive debts, lenders will repossess people’s homes if their debts are larger than the value of their property. As a result of swiftly increasing house prices over the last few years many people will not face this problem.

However, those who took a 100% mortgage and have fallen behind with payments remain in trouble, other people who many be in trouble are borrowers who began with modest loans and then took advantage of the equity in their property to fund car purchases, holidays or lifestyle choices.

According to the CML 129,000 borrowers have fallen more than three months behind with payments. Any borrowers with poor credit histories who are coming to the end of their affordable credit deals, may find it impossible to replace these agreements. This will mean they see payments increase and may struggle to meet these demands.

Despite the struggling market, mortgage deal demands from customers are still high, mortgage leads companies are still booming.

Many new properties have been overpriced and this has become apparent as the market has softened and the prices have tumbled, and fraudulent backgrounds to these price hikes have been revealed.

If a developer discounted a property by £50,000, for example, off a property selling for £200,000, the flat was still registered with the Land Registry for £200,000 even though the price paid was £50,000 less. This gave new buyers a false impression of the value of properties.
